BANGKOK – As long-anticipated international accountability measures for Myanmar gather pace, recent developments which at first seem to promise evidence for justice, on closer examination could potentially disrupt such investigations.

On September 8, the American nongovernmental organization Fortify Rights released a statement, in conjunction with the New York Times, of testimony by two Myanmar Army, or Tatmadaw, soldiers who claim to have perpetrated under military orders the murder of Rohingya Muslims in Rakhine state in 2017.

The ICJ verdict is an important first step toward ensuring that the Rohingya victims get some tangible justice.

On January 23, the International Court of Justice (ICJ) based in The Hague ordered Myanmar to take immediate measures to prevent the genocide of the stateless Rohingya Muslim minority, based in northern Rakhine state. This week, a comprehensive inquiry into the 2017 violence and mass displacement in the state of Rakhine presented its final report to Myanmar’s president. 

 

The Independent Commission of Enquiry interviewed close to 1,500 witnesses, including security personnel and affected persons. It has gathered more first-hand information than any other fact-finding body in the world.

A Rohingya advocacy group on Tuesday hit out at a Myanmar government-backed commission report that denied there was any genocide of the persecuted community.

In a statement, Europe-based Free Rohingya Coalition (FRC) slammed the findings of Myanmar's Independent Commission of Enquiry that there is "no" or "insufficient" evidence to establish the genocidal intent behind Myanmar's destruction of the Rohingya community.

A Rohingya activist has told Radio Islam the Independent Commission of Enquiry (ICOE) report is to “protect criminals from prosecution”. A commission set up to investigate the 2017 crackdown in Rakhine led hundreds of thousands of mostly Muslim Rohingya to flee Myanmar.

The report released on Monday to the country’s president Aung San Suu Kyi concludes that while some soldiers probably committed war crimes there was no genocide.

The report comes a few days before the United Nations' top court is set to rule on whether to impose urgent measures to stop the alleged continuing genocide in Myanmar.

Speaking to Radio Islam, Nay San Lwin says the release of the report’s findings is a "blatant PR exercise to deflect attention from the International Court and that the security forces are trying to get away from being prosecuted for genocide.

“As Myanmar is not a signatory of the Rome Statute, the International Criminal Court cannot also sue Myanmar criminals for these cases or these crimes. That is basically the report, to protect the criminals from prosecution.”

The four-member commission included two international representatives and was led by Rosario Manalo, a former deputy foreign minister of the Philippines. Lwin says Manalo has a friendship with Myanmar.

“We can see clearly that the relationship between them is friendly. They have a very good friendship and she was ready to cover-up all the crimes committed by the general that is why she was convinced to write this report.” The International Court of Justice (ICJ) is set to announce on Thursday its ruling on a case filed by Gambia against Myanmar on the persecution of the Rohingya.

ရှေ့နေချုပ်ရုံးက အလုပ်နှစ်ခု ဖြစ်သွားတယ်။ တစ်ခုက သာမန်အရပ်သားတွေ ကျူးလွန်တဲ့ လူ့အခွင့်အရေး ချိုး ဖောက်မှုတွေ၊ စစ်ရာဇဝတ်မှုတွေကို ရှေ့နေချုပ်ရုံးက ရဲတပ်ဖွဲ့ကို စုံစမ်းစစ်ဆေးစေပြီး တရားရုံးကို တင်ပို့တာ။

နောက်တစ်ခုက အာဆာကို အားပေးတဲ့ ဘင်္ဂါလီတွေကို စုံစမ်းစစ်ဆေးတာကို ထမ်းဆောင်တာလုပ်နိုင်တယ်။

ရခိုင်ပြည်နယ်မှာ ၂၀၁၆-၂၀၁၇ အာဆာတိုက်ခိုက်မှုတွေကို တပ်မတော်နဲ့ လုံခြုံရေးတပ်ဖွဲ့တွေက တုံ့ပြန်ရာမှာ လူ့အခွင့်အရေး ချိုးဖောက်မှုတွေရှိတယ်ဆိုတဲ့ စွပ်စွဲချက်တွေနဲ့ ပတ်သက်ပြီး စုံစမ်းစစ်ဆေးခဲ့တဲ့ အစီရင်ခံစာ အကျဉ်းချုပ် ဇန်နဝါရီ ၂၁ ရက်မှာ ထွက်လာခဲ့တာ ဖြစ်ပါတယ်။

လက်ရှိ အာဏာရ NLD အစိုးရက ၂၀၁၈ မှာ ဖွဲ့ပေးခဲ့တဲ့ လွတ်လပ်သော စုံစမ်းစစ်ဆေးရေး ကော်မရှင် (Independent Commission of Enquiry - ICOE) ရဲ့ အဆုံးသတ် အစီရင်ခံစာ အကျဉ်းချုပ်ထွက်လာပြီးနောက် တစ်ရက်မှာ ကျူးလွန်သူတွေကို စုံစမ်းစစ်ဆေးဖို့ ပြည်ထောင်စု ရှေ့နေချုပ်ရုံးက ကြေညာခဲ့ပါတယ်။

ဒီအစီရင်ခံစာထဲက စစ်ရာဇဝတ်မှုတွေ ဖြစ်ခဲ့နိုင်တယ်ဆိုတာတွေနဲ့ ပတ်သက်ပြီး တပ်မတော်ဘက်ကလည်း ဥပ ဒေနဲ့အညီ ဆက်လက်စုံစမ်း စစ်ဆေးသွားမယ်လို့ တုံ့ပြန်ထားပါတယ်။

NAYPYITAW, Myanmar (AP) - An independent commission established by Myanmar’s government has concluded there are reasons to believe that security forces committed war crimes in counterinsurgency operations that led more than 700,000 Rohingya Muslims to flee to neighboring Bangladesh.
