Mass arbitrary detention, life-threatening restrictions in Rakhine State

(BANGKOK, April 4, 2024)– The Myanmar military junta’s ongoing confinement of more than a half million Rohingya Muslims to internment camps and villages in Rakhine State constitutes a situation of mass arbitrary detention and an act of genocide under international law, said Fortify Rights today. According to a new investigation by Fortify Rights, the junta not only continues to confine Rohingya en masse, but it has also tightened restrictions on lifesaving humanitarian aid to Rohingya and Kaman Muslims in internment camps and villages throughout the state.

Criminal Complaint Filed in Germany Accuses Myanmar Military of Genocide, War Crimes

Campaign group Fortify Rights and 16 Myanmar nationals have filed a genocide and war crimes complaint against Myanmar’s military leaders in Germany in the latest bid to leverage the principle of universal jurisdiction against the country’s generals.

Fortify Rights announced the case Tuesday in Thailand, which shares a long and porous border with Myanmar, and says a 215-page complaint was filed with Germany’s federal public prosecutor on January 20. The prosecutor’s office must now decide whether to open an investigation.

The prosecutor’s office confirmed receipt of the complaint in an email to VOA but declined further comment.

Universal jurisdiction holds that some crimes, including genocide, are so heinous they transcend national borders and that they and their perpetrators can be tried anywhere.

Two Myanmar Army soldiers now in ICC custody in The Hague

(BANGKOK, September 8, 2020)—The International Criminal Court (ICC) should swiftly prosecute two Myanmar Army soldiers who confessed to their involvement in massacres, rape, and other crimes against Rohingya in Myanmar, and the court should facilitate witness protection for them, said Fortify Rights today. Fortify Rights has reason to believe Myanmar Army Private Myo Win Tun, 33, and Private Zaw Naing Tun, 30, are in the custody of the ICC and in The Hague.

“This is a monumental moment for Rohingya and the people of Myanmar in their ongoing struggle for justice,” said Matthew Smith, Chief Executive Officer at Fortify Rights. “These men could be the first perpetrators from Myanmar tried at the ICC, and the first insider witnesses in the custody of the court. We expect prompt action.”

Regional rights body 'Fortify Rights' has called for Malaysia to release detained refugees and prevent arbitrary detention of new arrivals to minimise health risks due to Covid-19.

"Malaysia should take extra precautions now to protect the rights of refugees and refrain from detaining them," said Matthew Smith, chief executive officer of Fortify Rights, in a statement today.

"Detaining refugees after they pass a quarantine and during a pandemic would be irresponsible and inhumane," he said.

Fortify Rights urges Myanmar govt

The government of Myanmar should take steps to urgently restore full citizenship rights for Rohingyas, Fortify Rights said yesterday.

New evidence collected by Fortify Rights, including eyewitness testimonies and internal government documents, confirms that Myanmar authorities are continuing to force and coerce Rohingyas to accept National Verification Cards (NVCs), which effectively identify them as foreigners and strip them of access to full citizenship rights.

“The NVC is widely known as an abusive tool, and the government should scrap it without delay,” said Matthew Smith, chief executive officer of Fortify Rights.

Bangladesh: Halt Plans to Relocate Rohingya Refugees to Isolated Island

Testimonies indicate relocations slated for next month would be involuntary

(BANGKOK, October 25, 2019)—The Government of Bangladesh should immediately halt plans to relocate Rohingya refugees from camps in Cox’s Bazar to Bhasan Char, an isolated and flood-prone island in the Bay of Bengal, Fortify Rights said today. On October 20, Bangladeshi officials announced plans to begin relocating refugees in early November.

Fortify Rights interviewed 14 Rohingya from three different refugee camps in Bangladesh, including Rohingya identified on lists of people slated for imminent relocation to Bhasan Char. None of those on the lists for relocation interviewed by Fortify Rights had been consulted about the plan and all opposed it.

“The island is not a sustainable solution for refugees and no one knows that better than the Rohingya themselves,” said Matthew Smith, Chief Executive Officer at Fortify Rights. “Threats of forced relocation cause unnecessary harm to refugee families already struggling to survive. Bangladesh authorities should engage in meaningful consultations with Rohingya and identify options to ensure rights and protection.”

A human trafficking syndicate committed crimes against humanity between 2012 and 2015 against Rohingya and Bangladeshi refugees trying to flee to Malaysia and Thailand, two Southeast Asia-based human rights groups said in a report on Wednesday.

In the joint 121-page work titled “Sold Like Fish,” the Human Rights Commission of Malaysia (SUHAKAM) and the Bangkok-based Fortify Rights provides accounts of survivors who were deceived by the traffickers, believing they were boarding boats to seek refuge abroad.
