Commodifying prisoners of war in Myanmar

BANGKOK – As long-anticipated international accountability measures for Myanmar gather pace, recent developments which at first seem to promise evidence for justice, on closer examination could potentially disrupt such investigations.

On September 8, the American nongovernmental organization Fortify Rights released a statement, in conjunction with the New York Times, of testimony by two Myanmar Army, or Tatmadaw, soldiers who claim to have perpetrated under military orders the murder of Rohingya Muslims in Rakhine state in 2017.

On August 4, 2020, the legal representatives of three specific groups of Rohingya victims submitted a joint request to the Pre-Trial Chamber of the International Criminal Court (ICC), requesting it to direct the Registry of the Court to prepare an assessment of potential venues for holding the Court's proceedings in a state other than the host state (i.e. the Netherlands) so that proceedings can be held in a location which is physically closer to the victims of the alleged atrocities, who are currently residing in various refugee camps in Cox's Bazar, Bangladesh. In brief, the victims requested the Court to direct the Registry to explore whether the proceedings could be held in a location physically closer to Cox's Bazar, where the victims are currently residing.

looked steadily into the camera as he recounted two weeks in August 2017 when he and his battalion laid waste to several villages in Rakhine, a state in the far west of Myanmar. They were there, he said, as part of the Burmese army’s “clearance operations” targeting the Rohingya, a persecuted Muslim ethnic minority, which sparked the exodus of more than 740,000 Rohingyas to neighbouring Bangladesh. Mr Myo Win Tun confessed to participating in the massacre of 30 Rohingyas, whom he helped to bury in a mass grave, and to raping one woman. In another video, Private Zaw Naing Tun said that his battalion “wiped out about 20 Muslim villages”, and that he stood sentry while his superiors raped women. Based on their accounts, Fortify Rights, a human-rights NGO which obtained the footage, believes these two men may be directly responsible for killing 180 Rohingyas.

Two Australian lawyers acting on behalf of hundreds of Rohingya refugees are pushing to have the International Criminal Court (ICC) sit in Asia for the first time.

The ICC is investigating allegations of genocide and crimes against humanity allegedly committed by Myanmar Government and military officials in 2017.

Hundreds of thousands of Rohingya — a stateless, mostly Muslim minority group — fled to neighbouring Bangladesh during the unrest.

The US has imposed sanctions on senior officials in the International Criminal Court (ICC), including chief prosecutor Fatou Bensouda.

Secretary of State Mike Pompeo accused the court of "illegitimate attempts to subject Americans to its jurisdiction".

The Hague-based ICC is currently investigating whether US forces committed war crimes in Afghanistan.

The US has criticised the court since its foundation and is one of a dozen states which have not signed up.

ICC: Shy hope for Uyghurs and Rohingyas

 China and Burma have not ratified the Rome Statute establishing the International Criminal Court. However, crimes committed against these minorities can be prosecuted if part of the facts concerns signatory countries.

Extremely serious crimes on a very large scale. While the abuses against the Syrians are finally starting to be investigated and condemned, those committed against Uyghurs in China and Rohingyas in Burma have not yet arrived at this stage. The judicial calendar is rarely in tune with the media, but this does not prevent the recent months, justice has scored points in the prosecution of the perpetrators of recent crimes against humanity, even genocide.

In August 2017, Myanmar Tatmadaw, or the military, launched the "Security Clearance Operations," which resulted in the exodus of 750,000 Rohingya from across the borders into the adjacent Bangladesh city of Teknaf.

As my colleagues Param-Preet Singh and Nadira Kourt laid out in the first two pieces of this forum, the International Court of Justice (ICJ) case concerning Myanmar’s genocide of the Rohingya presents opportunities for Myanmar to finally dismantle the root causes of its longstanding persecution of Rohingya people and the international community to live up to its promise of “Never Again.” In this final forum article, I look at what all the recent international attention paid to Myanmar’s treatment of the Rohingya means for other ethnic minorities that have suffered atrocities at the hands of Myanmar’s military (the Tatmadaw).

Experts on Thursday said in a special online seminar there are possibilities for reconciliation between the two largest co-habiting ethnic communities of Rakhine – Rakhine and Rohingya.

They also opined that reconciliation is a must before repatriation of Rohingyas in Myanmar.

The seminar titled "What Future for Rakhine?: End Games for the Arakanese (Rakhine, Rohingyas and Other Co-habitants)" was jointly organised by Free Rohingya Coalition, Forces of Renewal Southeast Asia and SOAS School of Interdisciplinary Studies.
