The Myanmar military junta should end the ongoing Rohingya genocide and atrocities against other civilians and fulfill legally binding provisional measures issued in 2020 by the International Court of Justice in The Hague, said Fortify Rights.

The ICJ, also known as the World Court, published a ruling rejecting the military junta’s request for an extension in a historic genocide trial initiated against Myanmar in 2019.

‘Today’s ruling is another in a series of defeats for the Myanmar junta at The Hague,’ said Matthew Smith, Chief Executive Officer at Fortify Rights on Friday.

‘The same generals responsible for the Rohingya genocide wanted to significantly delay the genocide trial, and the court was right to reject their request.’

Ahead of this month’s deadline to submit arguments and evidence to the International Court of Justice, the military regime has been using questionable methods to collect testimony from Rohingya, at times even allegedly pressuring them to change their story.

 

Ko Win Maung’s* village in Rathedaung Township, once home to a large Rohingya population, was one of the first to be attacked in 2017 during the military’s crackdown in northern Rakhine State. It was shortly after lunchtime on August 25 when soldiers arrived in Zaydipyin and began torching houses, forcing Win Maung and more than 650 other Rohingya to flee.

Gambian Foreign Minister Dr Mamadou Tangara has expressed his hope that more countries will make contributions to Gambia regarding the Rohingya genocide case at the International Court of Justice (ICJ) as the African nation has been facing a fund crisis to run the case.

"We need concrete action. Help us to make more noises so that their (Rohingyas) voices can be heard," he told reporters after holding a bilateral meeting with Bangladesh foreign minister Dr AK Abdul Momen at a state guesthouse in Dhaka on Sunday evening, reports BSS.

Military Council ministers visited Rakhine to counter Rohingya genocide case against the Myanmar government filed at the ICJ International Court of Justice

The Military Council sent a ministerial team led by U Ko Ko Hlaing, Deputy Chairman of the Steering Committee on Litigation at the ICJ and Minister of International Cooperation, to visit Rakhine state to prepare a counter- claim to the genocide charges filed by Gambia (western African state) against Myanmar at the International Court of Justice (ICJ).

The Gambia has filed a case at the International Court of Justice (ICJ), claiming that Myanmar military committed genocidal crimes against Rohingya Muslims during the 2017 riots in the Maungdaw region of Rakhine State.

International community and States Parties of Rome Statute need to stand resolutely with Bangladesh in securing sustainable return of the Rohingya people to their homeland, Myanmar, speakers told a discussion in the city.

They underlined it at an event during the 21st (annual) Assembly of the States Parties of the International Criminal Court (ICC) in the Hague on Friday, said a press release.

The event titled “Justice for the Rohingyas and No Peace without Justice” was co-hosted by the Bangladesh Embassy to the Netherlands, the Government of Gambia.

The Rohingya continue to face a genocide that puts their very survival at risk, the Burmese Rohingya Organisation UK (BROUK) said in a new report released 2 November.

The International Court of Justice (ICJ) ordered provisional measures to prevent ongoing genocide against the Rohingya minority in Myanmar. However, a new report by the Burmese Rohingya Organisation UK exposes how the Burmese military and other organisations are ignoring the provisional measures and that genocide is ongoing. It is the responsibility of the United Nations Security Council to uphold the ruling of the UN court, but it is failing to do so.

Bangladesh Ambassador to the Kingdom of Saudi Arabia and Permanent Representative to the Organization of Islamic Cooperation (OIC) Mohammad Javed Patwari has sought the help of OIC member states to continue the Rohingya genocide case lodged by Gambia at the International Court of Justice (ICJ).

Javed sought the help at the ad-hoc meeting of OIC ministers on Myanmar's accountability for violating human rights of Rohingyas, held in Jeddah on Thursday.

Five years since the 2017 exodus of Rohingya refugees from Myanmar as a result of its military's horrific persecution, there is no sign of repatriation on the horizon. And as long as the military junta continues to rule, there is hardly any scope for repatriation. This was reflected by Myanmar's Senior General Min Aung Hlaing in 2017, when he said in a media interview, "we did not send them to bring them back."

Even after the military coup in February 2021, when the junta was under tremendous pressure from inside and outside, General Min Aung Hlaing reiterated in May 2021, in an interview with an international media outlet, that there is "no option of bringing back the Rohingyas". Whatever discussions on repatriation we hear and see are part of diplomatic rhetoric; no serious analyst would take it at face value. However, it is always better to have engagement with the present Myanmar government on this issue rather than a complete disengagement.

The United Nations’ highest court has rejected Myanmar’s attempts to halt a case accusing it of genocide against the country’s Rohingya minority, paving the way for evidence of atrocities to be heard.

The international court of justice rejected all preliminary objections raised by Myanmar, which is now ruled by a military junta, at a hearing on Friday.

The case, which was filed by the Gambia, centres on brutal military crackdowns in 2016 and 2017 that forced more than 700,000 Rohingya to flee over the border to neighbouring Bangladesh.

Judges at the United Nations’ highest court on Friday dismissed preliminary objections by Myanmar to a case alleging the Southeast Asian nation is responsible for genocide against the Rohingya ethnic minority.

The decision establishing the International Court of Justice’s jurisdiction sets the stage for hearings airing evidence of atrocities against the Rohingya that human rights groups and a U.N. probe say breach the 1948 Genocide Convention. In March, U.S. Secretary of State Antony Blinken said that the violent repression of the Rohingya population in Myanmar, which formerly was known as Burma, amounts to genocide.
