Argentine Court: Rohingyas testify about the horrors they faced

In a historic development for Myanmar, Rohingya women have described in an Argentine court of law, under the aegis of universal jurisdiction, how the Myanmar military carried out a brutal massacre in their village.

Speaking remotely to the Federal Criminal Appeals Court in Bueno Aires from the world's largest refugee camp in Cox's Bazar on Tuesday, the women spoke of how soldiers killed their husbands in Chuk Pyin of Myanmar's Rakhine, according to a statement from the Burmese Rohingya Organization UK (BROUK).

They said soldiers killed hundreds of people, while some women were raped before being killed. The soldiers went on to rape many other women in their village and then burned their homes to the ground.

The Myanmar military regime has organized a new legal team led by its foreign minister, U Wunna Maung Lwin, to present the defense in the Rohingya genocide case at the International Court of Justice (ICJ) in The Hague.

The regime’s order restructuring the committee, which was previously led by detained State Counselor Daw Aung San Suu Kyi, was announced in a bulletin published by the Myanmar Gazette on Thursday.

The panel has eight members. Among them are two former military officers—U Wunna Maung Lwin, who will serve as chairman; and the regime’s planning, finance and industry minister, U Win Shein—and two serving lieutenant generals: Yar Pyae and Adjutant General Myo Zaw Thein.

Myanmar junta’s military council has set up a legal team to defend itself against allegations of genocide of Rohingya Muslims at the International Criminal Court (ICJ) on July 23.

Foreign Minister Wunna Maung Lwin, appointed by the military council, chaired the meeting. Attorney General of the Union Daw Thida Oo has been appointed as the Vice-Chairperson.

LETTERS: The Burmese Rohingya Organisation UK (BROUK) welcomes new sanctions announced by the EU and the UK on June 21st, targeting more financial interests of the Myanmar military as well as individuals with links to the military dictatorship.

It is of outmost importance that the international community keeps the pressure on the Myanmar military.

Rohingya, as genocide survivors, stand shoulder to shoulder with the people of Myanmar protesting the illegal military regime, and the international community must do all they can to support Myanmar's struggle for true federal democracy.

Myanmar’s NUG pledges to comply with ICJ directives

Myanmar's National Unity Government has pledged to comply with the directives of the International Court of Justice, which last year ordered the country to prevent any acts of genocide against the Rohingyas in Rakhine State.

"The National Unity Government (NUG) is taking every step to cooperate with the International Court of Justice, the world's highest court, and, by that, to ensure that we comply with Myanmar's international legal obligations," Dr Sasa, union minister of international cooperation and spokesperson of Myanmar's shadow government, said in a statement yesterday.

A UK-based Rohingya rights defender, the Burmese Rohingya Organization UK (BROUK), in a new report claimed “the genocide against Rohingya shows no sign of abating in Myanmar” despite the order of the UN's highest court to the Myanmar authorities for protecting the minority community.

“Since the start of 2021, at least 15 Rohingya -- including nine infants and young children -- have died as a direct result of onerous and illegal travel restrictions preventing access to medical care,” the report released on Monday said.

The release has also coincided with Myanmar’s duty to report to the International Court of Justice (ICJ), on how it is preventing genocidal acts against the minority Rohingya Muslims in Rakhine State.

The genocide against the Rohingyas shows no sign of abating in Myanmar, the Burmese Rohingya Organisation UK (BROUK) said in a new briefing yesterday.

It said the Myanmar military continues to subject the Rohingyas to a vicious pattern of abuse and extortion in the Rakhine State, where Rohingyas are kept in what amounts to an open-air prison, creating intolerable living conditions.

Since the start of this year, at least 15 Rohingya, including nine infants and young children, have died as a direct result of onerous and illegal travel restrictions preventing access to medical care, said BROUK President Tun Khin in a statement.

The ongoing case on behalf of the Rohingya people at the International Court of Justice (ICJ) against Myanmar for genocide has been initiated and championed by the small nation of The Gambia and has broken new ground in international law for being the first case of its kind brought by one UN country against another. In truth, all signatories to the UN Genocide Convention have the ability, and indeed the moral responsibility, to prosecute the crime of genocide wherever it may occur. And the UK should lend its full backing to the action by The Gambia.

This step seems to have become more likely with over 100 members of parliament signing a letter addressed to the government that the UK should be joining the legal action led by The Gambia. Among the signatories is the former UK Foreign Secretary, Rt Hon Jeremy Hunt MP, which lends further weight to this initiative.

In August 2017, the Myanmar military perpetrated a genocide on the Rohingyas, an ethnic group residing in Northern Rakhine. Large numbers of Rohingyas were killed, women and girls were raped, villages burnt and upwards of 800,000 men, women and children were driven out of their homes. They crossed the border into Bangladesh to save their lives and are now sheltered in camps in Teknaf and Ukhia, in the southern tip of Bangladesh.

Although this outrageous event was sort of a 'final solution', atrocities on Rohingyas have a long history. The first mass expulsion took place in 1977-78 when 250,000 were driven across the border. Most of them were sent back through negotiations. However, following the second mass expulsion in 1989-90, many of the 250,000 refugees could not be sent back. Meanwhile, the Burmese Citizenship Act of 1982 disenfranchised the Rohingyas of their citizenship. Under continued atrocities by the military and the local Rakhines led by extremist Buddhist monks, a slow exodus continued till 2016, when another 80,000 were expelled. At least 300,000 Rohingyas were displaced in Bangladesh before 2017.
