On June 8, 2020, The Gambia filed an application for discovery with the U.S. District Court for the District of Columbia. The application asks the Court to compel Facebook to provide information related to the personal Facebook accounts of Myanmar officials. The information that The Gambia seeks is to be used in an action brought by The Gambia against Myanmar in the International Court of Justice (ICJ) in The Hague, The Netherlands.

BANGKOK – As long-anticipated international accountability measures for Myanmar gather pace, recent developments which at first seem to promise evidence for justice, on closer examination could potentially disrupt such investigations.

On September 8, the American nongovernmental organization Fortify Rights released a statement, in conjunction with the New York Times, of testimony by two Myanmar Army, or Tatmadaw, soldiers who claim to have perpetrated under military orders the murder of Rohingya Muslims in Rakhine state in 2017.

The country is working ‘extremely hard with international lawyers,’ Cherno Marenah of Gambia’s Ministry of Justice says

The Gambia will submit the first memorandum in the case at the International Court of Justice (ICJ) over Rohingya issue in October, Cherno Marenah, solicitor general and legal secretary at the Gambia's Ministry of Justice, has said.

"We are working extremely hard along with international lawyers," he said, adding that the Gambia always takes the lead when it comes to humanitarian crises, and they are especially active in the African continent.

(Editors Note: This article is the fourth and final piece of a special Just Security forum on the ongoing Gambia v. Myanmar litigation at the International Court of Justice and ways forward.) 

As my colleagues Param-Preet Singh and Nadira Kourt laid out in the first two pieces of this forum, the International Court of Justice (ICJ) case concerning Myanmar’s genocide of the Rohingya presents opportunities for Myanmar to finally dismantle the root causes of its longstanding persecution of Rohingya people and the international community to live up to its promise of “Never Again.” In this final forum article, I look at what all the recent international attention paid to Myanmar’s treatment of the Rohingya means for other ethnic minorities that have suffered atrocities at the hands of Myanmar’s military (the Tatmadaw).

Experts on Thursday said in a special online seminar there are possibilities for reconciliation between the two largest co-habiting ethnic communities of Rakhine – Rakhine and Rohingya.

They also opined that reconciliation is a must before repatriation of Rohingyas in Myanmar.

The seminar titled "What Future for Rakhine?: End Games for the Arakanese (Rakhine, Rohingyas and Other Co-habitants)" was jointly organised by Free Rohingya Coalition, Forces of Renewal Southeast Asia and SOAS School of Interdisciplinary Studies.

(Bangkok) – Myanmar’s court-martial conviction of three military personnel for crimes against ethnic Rohingya reflects ongoing government efforts to evade meaningful accountability, Human Rights Watch said today. Myanmar authorities have repeatedly failed to adequately investigate and prosecute grave abuses against Rohingya in Rakhine State, including crimes against humanity.
