International Criminal Court: Prosecute and Offer Witness Protection to Myanmar Army Deserters

FORTIFY RIGHTS

Two Myanmar Army soldiers now in ICC custody in The Hague

(BANGKOK, September 8, 2020)—The International Criminal Court (ICC) should swiftly prosecute two Myanmar Army soldiers who confessed to their involvement in massacres, rape, and other crimes against Rohingya in Myanmar, and the court should facilitate witness protection for them, said Fortify Rights today. Fortify Rights has reason to believe Myanmar Army Private Myo Win Tun, 33, and Private Zaw Naing Tun, 30, are in the custody of the ICC and in The Hague.

“This is a monumental moment for Rohingya and the people of Myanmar in their ongoing struggle for justice,” said Matthew Smith, Chief Executive Officer at Fortify Rights. These men could be the first perpetrators from Myanmar tried at the ICC, and the first insider witnesses in the custody of the court. We expect prompt action.

Myanmar Desertions Offer an Opening for Rohingya Justice

THE I DIPLOMAT
By Shannon Maree Torrens
September 30, 2020

The recent confessions of the two Myanmar army defectors bring justice one step closer to fruition.

The long-term persecution of the Rohingya Muslims in Myanmar, which dates back to the 1970s, has become particularly grave in recent years, as increasing crackdowns have coincided with mounting challenges to the pursuit of justice. However, a new opportunity for justice for the Rohingya has recently opened, in the form of the International Criminal Court (ICC) in The Hague.

The Registry of the International Criminal Court has filed its observations on a joint request by the victims to hold the hearings in the Rohingya genocide case within reasonable proximity of the affected populations, instead of The Hague.

In its filing submitted on September 21, which is available on the ICC’s website, the Registry outlines five possible scenarios whereby all or some part of the hearings may be held in Bangladesh, and details the pros and cons of each.

New York Times and Fortify Rights may have endangered Rohingya justice initiatives by trumpeting captured Myanmar soldiers' testimony

BANGKOK – As long-anticipated international accountability measures for Myanmar gather pace, recent developments which at first seem to promise evidence for justice, on closer examination could potentially disrupt such investigations.

On September 8, the American nongovernmental organization Fortify Rights released a statement, in conjunction with the New York Times, of testimony by two Myanmar Army, or Tatmadaw, soldiers who claim to have perpetrated under military orders the murder of Rohingya Muslims in Rakhine state in 2017.

On August 4, 2020, the legal representatives of three specific groups of Rohingya victims submitted a joint request to the Pre-Trial Chamber of the International Criminal Court (ICC), requesting it to direct the Registry of the Court to prepare an assessment of potential venues for holding the Court's proceedings in a state other than the host state (i.e. the Netherlands) so that proceedings can be held in a location which is physically closer to the victims of the alleged atrocities, who are currently residing in various refugee camps in Cox's Bazar, Bangladesh. In brief, the victims requested the Court to direct the Registry to explore whether the proceedings could be held in a location physically closer to Cox's Bazar, where the victims are currently residing.

Two Burmese soldiers confess to war crimes against the Rohingya

PRIVATE MYO WIN TUN
looked steadily into the camera as he recounted two weeks in August 2017 when he and his battalion laid waste to several villages in Rakhine, a state in the far west of Myanmar. They were there, he said, as part of the Burmese army’s “clearance operations” targeting the Rohingya, a persecuted Muslim ethnic minority, which sparked the exodus of more than 740,000 Rohingyas to neighbouring Bangladesh. Mr Myo Win Tun confessed to participating in the massacre of 30 Rohingyas, whom he helped to bury in a mass grave, and to raping one woman. In another video, Private Zaw Naing Tun said that his battalion “wiped out about 20 Muslim villages”, and that he stood sentry while his superiors raped women. Based on their accounts, Fortify Rights, a human-rights NGO which obtained the footage, believes these two men may be directly responsible for killing 180 Rohingyas.

Bangladesh's Rohingya refugees lobby ICC to sit in Asia during war crimes investigation

ABC Net
By Angelique Lu

Two Australian lawyers acting on behalf of hundreds of Rohingya refugees are pushing to have the International Criminal Court (ICC) sit in Asia for the first time.

The ICC is investigating allegations of genocide and crimes against humanity allegedly committed by Myanmar Government and military officials in 2017.

Hundreds of thousands of Rohingya — a stateless, mostly Muslim minority group — fled to neighbouring Bangladesh during the unrest.

International Criminal Court officials sanctioned by US

The US has imposed sanctions on senior officials in the International Criminal Court (ICC), including chief prosecutor Fatou Bensouda.

Secretary of State Mike Pompeo accused the court of "illegitimate attempts to subject Americans to its jurisdiction".

The Hague-based ICC is currently investigating whether US forces committed war crimes in Afghanistan.

The US has criticised the court since its foundation and is one of a dozen states which have not signed up.
